A Pittsburgh-area man killed an intruder upon returning fire outside his garage early this morning, police said.

The shooting started about 3:45 a.m. after a man called 911 to report that someone was in his garage in the 100 block of East Eugene Avenue.

The Allegheny County medical examiner’s office identified the intruder as Andrew Stevens, 23, of Munhall. He was found shot to death on Victor Way, an alley by the garage.

    Defense world: This was not a case of defense. The deceased was in a public alley behind his home. His roomate saw a car under a tarp through a rotted-out garage door panel and crawled in out of curiosity to see what kind of car it was. That is not justifyable, but the deceased was comitting no crime. The deceased was a recently-discharged Marine. He “supposedly” fired first, emptied his clip from 5 feet away and did not hit the homeowner. The homeowner supposedly fired as he was running away from that gunfire, shot 9 times, and hit the victim multiple times. The facts don’t add up. The man who killed the victim felt the need to go try to hold the boys at gunpoint, even though the police were called and were only moments away in this tiny municipality. He made a horrible decision to take his gun and threaten a young ex-Marine just back from service in Afganistan in the middle of the night, and the Marine paid the price for defending himself.

    so entering someone else’s property through a rotted out garage door panel wouldn’t be considered breaking and entry??? and if he was carrying while he did this, breaking and entry with a weapon???
