The fatal shooting of a home intruder last Friday in Cheltenham appears to have been justifiable, according to Montgomery County District Attorney Risa Vetri Ferman.

The 20-year-old Lynnewood Gardens apartment resident, who used an AR-15 semi-automatic rifle to shoot the intruder, was in fear of his life and the lives of others in the apartment, said Ferman.

“You have a man who defended himself inside his home, as the law would generally permit, and exercised extreme restraint by firing only one shot in shooting someone who was unlawfully in his home,” said Ferman.

Ferman said Wednesday she was not yet prepared to issue an “official” ruling because the investigation is ongoing and authorities are waiting for the toxicology reports on the person who was killed.
