No charges will be filed against a Reading, Pennsylvania man who shot and killed an armed robber last week.

According to the Reading Eagle, the 23-year-old unidentified victim was walking in the 1300 block of North 12th Street at around 9 p.m. on Wednesday when three teenagers approached from behind, knocked him down to the ground and started punching and kicking him.

The victim was held down by 17-year-old Daquill Fuller while two other suspects — Kristan A. Diaz-Cruz Jr. and Jaylen Jefferson — went through his pockets.

Upon realizing that Fuller was armed with a silver revolver, the victim pulled out his concealed carry handgun and fired a shot into the air, causing Diaz-Cruz Jr. and Jefferson to flee the scene. Fuller, however, continued attacking him.

As the Reading Eagle reports, that’s when the victim opened fire, shooting Fuller three times.

Fuller was transported to Reading Hospital, succumbing to his injuries two hours later. The victim was taken to Penn State Health St. Joseph hospital to be treated for a broken nose and bruises and cuts to his face.

“He had very, very little choice but to use deadly force in this situation,” Berks County District Attorney John T. Adams said. “He was literally laying on the ground being beaten up when he fired his gun.”

The victim’s version of events was corroborated by multiple eyewitnesses, one of whom identified Diaz-Cruz and Jefferson. The two remaining suspects were arrested and face charges of robbery, conspiracy, aggravated assault and related offenses, the Reading Eagle said.
